I would wager that when the car driver checked his mirror that the moto was so far back he never saw him. Or if he did, he never expected such high closing speeds. I’m putting that one squarely on the moto.

Even if you look in your mirrors and over your shoulder you never see those guys. Being in California where lane splitting has never been outlawed, I see this all of the time. It's scary.

How can you be more cautious when a moto is closing on you lets say 60 km/hr faster than you are going? You can do mirror- signal-head check and still not see them coming up at that speed.

The moto riders in CA terrify me when they start lane splitting at >50 mph. A car is going to win every time in a motorcycle vs car collision.

The motorcyclist wasn’t going going that much faster. I think the driver got  got confused by the motorcycle ahead, once it passed, they thought the way was clear. 

I guess loudpipes don’t save lives.

Where I live it’s “legal” and they do that shit. I just learned to be extremely cautious when changing lane. But I’m not blaming the driver. It’s absolutely the rider’s fault.

Yes, it’s the cyclist' fault. I think he was confused by the bike that already passed.

Technically speaking, at least here in California, the way it works is that if the motor is in your lane, and there is contact, it’s the motor fault because they’re in your lane. But if you hit them and they’re in the other lane then technically, it’s your fault. But, I think you can argue if the motor is violating the new lane splitting laws then it’s their fault, no matter which lane they’re in. Motors aren’t allowed to split lanes over 45mph, and they can’t go more than 15 mph faster than the flow of traffic.

Tough one. I was ready to blame both, but now I’m starting to think that maybe that wasn’t an intentional sideswipe after all. I see the Audi driver signaling to merge, shortly before returning to the right lane immediately after he was done passing the slow traffic- like any decent human being would. So h e might not have been going out of his way to hurt the guy at all. He probably didn’t even see him coming, at that speed.

At what point is there a difference between “filtering” and “lane splitting? ” As I understand it, and I’m a rider, is that filtering is when the smaller bikes, which are faster off the line, filter to the front at a stop light. Lane splitting is when you go between cars at speed. I have no problem with filtering, but I think lane splitting is dangerous and shouldn’t be allowed.

I think you are right on the terms, but they end up being used interchangeably.

I have no problem with either, given the right speed differential, and driver training.  In other words, it would be suicide with the driver talent pool in my area, and I couldn’t support splitting here.
